1. Acceptance, eligibility, and scope
By using this website, a visitor agrees to these Terms of Use to the extent permitted by applicable law. A visitor who does not agree should stop using the website. Users must have legal capacity to use the site and must use it only for lawful business, product-research, documentation, support, and inquiry purposes.
These website terms do not replace or modify an accepted quote, order acknowledgment, invoice, contract, rental agreement, warranty, project agreement, manufacturer instruction, or other transaction-specific document. Those documents control their respective subject matter.
2. Website and product information
Website descriptions, specifications, part numbers, availability statements, downloadable documents, photographs, diagrams, and illustrations are general references and may change. Typographical, transcription, migration, calculation, source-document, and availability errors may occur and may be corrected. Product information must be confirmed for the exact model, revision, system, and transaction.
A “Product Image Coming Soon” graphic is a placeholder and does not represent the exact component. Other images may show examples, options, surroundings, or configurations not included in a quote. Illustrations are not scale drawings. Similar-looking scaffold parts are not necessarily compatible.
3. Quote requests and order acceptance
Submitting a form, adding an item to a quote basket, sending photographs, or discussing a project is an inquiry only. It does not reserve inventory, guarantee availability or lead time, establish price, approve compatibility, create an engineering decision, or constitute acceptance of an order. Binding obligations arise only under the applicable written commercial documents and required approvals.
Visitors are responsible for checking information they submit, including part numbers, dimensions, quantity, model or series, application, delivery details, and authority to provide files.
4. Permitted and prohibited use
Upright Scaffold grants a limited, revocable, nonexclusive permission to view and use the website for legitimate internal business and purchasing purposes. No ownership right is transferred.
Users may not attempt unauthorized access; introduce malicious code; interfere with security or operation; impersonate another person; submit unlawful or infringing material; scrape or harvest content at a volume that disrupts service; bypass technical controls; use site content to misrepresent a product; or use the website in violation of applicable law. Ordinary search-engine crawling and reasonable manual product research are not prohibited.
5. Intellectual property
Website text, organization, graphics, branding, and original materials are owned by or licensed to Upright Scaffold and are protected as applicable. Product documents, manufacturer names, trademarks, and third-party materials remain subject to their owners’ rights. A website reference to a third party does not imply ownership, endorsement, certification, or affiliation.
Visitors may retain reasonable copies for evaluating a purchase or maintaining transaction records, but may not republish, sell, remove notices from, or create misleading derivative commercial materials from protected content without permission.
6. Customer submissions and uploads
A person submitting text, photographs, measurements, drawings, or other files represents that the person is authorized to provide them and that their use for the inquiry will not violate another person’s rights. Submissions must not contain malware, unlawful content, classified information, export-controlled technical data, unnecessary personal data, or proprietary material the submitter is not permitted to disclose.
To the extent necessary to evaluate and administer the inquiry, the submitter permits Upright Scaffold and relevant service providers, suppliers, manufacturers, freight carriers, and professional advisers to review and use the submitted material. This permission does not transfer ownership and does not require public publication.
7. No engineering or safety advice
Website content is not erection instruction, engineering advice, an inspection, a site-specific safety assessment, or authorization to use equipment. Selection, assembly, alteration, movement, inspection, maintenance, dismantling, and use must follow current manufacturer instructions, employer programs, applicable law, and required competent-person or qualified-person review.
A quote or compatibility discussion does not replace verification of dimensions, connection methods, load information, foundations, environment, clearances, fall protection, or other site hazards.
8. Third-party links and availability
External websites and services are controlled by their operators and may have different terms and practices. Links are provided for context and do not guarantee continued availability, accuracy, or endorsement. Website access may be interrupted, changed, restricted, or discontinued.
9. Website disclaimers and liability limits
To the maximum extent permitted by law, the website is provided on an “as available” basis without a promise that it will be uninterrupted, error-free, or suitable for a particular project. Nothing in these terms excludes a warranty, duty, remedy, or liability that cannot lawfully be excluded.
To the maximum extent permitted by law, Upright Scaffold is not responsible for losses caused solely by reliance on unconfirmed website information, unauthorized use, third-party sites, or interruption of the website. Transaction-specific responsibility is governed by the applicable written agreement. Any indemnity obligation exists only when stated in an applicable written agreement or required by law.
10. Governing terms, changes, and contact
Florida law applies to these website terms to the extent a governing-law provision is enforceable and no controlling written agreement states otherwise. Venue and county are not specified here pending legal and business confirmation. If a provision is unenforceable, the remaining provisions continue to the extent permitted. Failure to enforce a provision is not a waiver.
Upright Scaffold may update these terms by posting a revised version with a new Last Updated date. Questions may be submitted through the contact process below.
